Our lawyers have extensive experience representing the State’s many municipalities, counties, and political subdivisions. We routinely defend public entities that have been sued for civil rights violations under 42 U.S.C. § 1983 in matters alleging wrongful arrest, illegal search and seizure, excessive force and wrongful death, termination of employment without due process of law, and jail-based violations of liberty and property. In addition, we represent public entities that have been sued under the New Mexico Tort Claims Act, which may encompass claims of premises liability, negligent operation of utilities, medical malpractice, and law enforcement liability.
State and Local Government Law

Cannabis Law

Cannabis law is one of the most expansive and complex areas of law in the United States, largely because it remains federally illegal under the federal Controlled Substances Act while legal under New Mexico state law. Cannabis is unique, because virtually every aspect of the business and the law is not treated like any other crop or business. There are special provisions and rules applicable to cannabis that are not immediately obvious to a firm that practices in commercial or agricultural law.
